Property Title Fraud in Ontario:

What Homeowners Need to Know

Property title fraud, once considered rare, is now a growing concern in Ontario’s real estate market. Recent years have seen a surge in reported cases, particularly in the Greater Toronto Area, where at least 30 homes have been fraudulently sold or mortgaged without the owners’ knowledge since 2019. This alarming trend has left many homeowners wondering how such crimes occur—and, more importantly, how to protect themselves.

How Does Title Fraud Happen?

Title fraud typically begins with identity theft. Criminals gather personal information—such as names, addresses, and Social Insurance Numbers—through phishing, data breaches, or stolen mail. With this information, they create forged identification documents and impersonate homeowners in dealings with real estate professionals, lawyers, or banks.

There are several common schemes:

- Forged Documents and Signature Fraud: Fraudsters create counterfeit deeds or legal documents, forging the homeowner’s signature. Once these are registered with the land registry office, the title appears to have been legally transferred.

- Mortgage Fraud: Using stolen or fake IDs, scammers apply for a mortgage in the homeowner’s name. The funds are diverted to the fraudster, and the real owner may only discover the fraud when they receive unexpected mortgage statements or legal notice.

- AI-Enhanced Forgery: The rise of artificial intelligence has enabled criminals to generate highly realistic fake documents, making it even harder for professionals to spot fraudulent activity.

Why Is Title Fraud Increasing?

Several factors contribute to the rise of title fraud in Ontario:

- High property values make homes lucrative targets.

- Technological advances in document forgery and identity theft.

- Remote and digital transactions have become more common, reducing face-to-face verification.

- Targeting of vulnerable properties, such as those that are mortgage-free, vacant, or owned by seniors.

What Remedies and Protections Exist?

Ontario has taken legislative steps to protect homeowners, including amendments to the Land Titles Act that render fraudulent transfers null and void and speed up compensation for victims. However, prevention remains the best defense.

How Can Homeowners Protect Themselves?

- Purchase Title Insurance: This is the most effective safeguard. Title insurance covers financial losses and legal costs if you become a victim of title fraud. It is available to both new and existing homeowners and is strongly recommended by legal professionals.

- Safeguard Personal Information: Keep identification documents secure, shred sensitive paperwork, and be wary of sharing personal details online or over the phone.

- Monitor Your Property Title: Regularly check your property’s status through the provincial land registry or set up alerts if available. Some experts suggest using Google Alerts to notify you if your address appears in real estate listings.

- Work with Trusted Professionals: Only deal with licensed real estate agents, mortgage brokers, and lawyers. Ontario now requires digital identity verification for real estate lawyers, adding another layer of protection.

- Be Vigilant for Red Flags: Be cautious if someone pressures you to rush a transaction or refuses in-person meetings. Always read and understand documents before signing.

If You Suspect Fraud:

- Contact your financial institution and local police.

- Notify the land registry office.

- Report the incident to the Canadian Anti-Fraud Centre.

Title fraud is a serious but preventable threat. By staying informed, securing your information, and investing in title insurance, homeowners can significantly reduce their risk and protect their most valuable asset.
